1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and Solix Hub Pty Ltd (ABN 63 655 229 379) ("Solix", "we", "us"). By creating an account or using the Solix platform at solix.com.au, you agree to be bound by these Terms and our Privacy Policy.

If you are using Solix on behalf of a business or organisation, you represent that you have authority to bind that entity to these Terms.

2. Description of Service

Solix is a cloud-based construction project management platform designed for Australian builders, property developers, and owner-builders. The platform provides tools for project tracking, quote management, cost summaries, site mapping, and subscription-based access to advanced features.

3. Account Registration

To use Solix, you must:

• Be at least 18 years of age.
• Provide accurate, complete, and current registration information.
• Maintain the security of your account credentials and notify us immediately of any unauthorised access.
• Accept responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

4. Free Trial and Subscriptions

New accounts receive a 14-day free trial with access to platform features. No credit card is required to start a trial. At the end of the trial period, continued access requires a paid subscription.

Subscription plans are billed in Australian Dollars (AUD) on a monthly or annual basis. Prices are as displayed on our pricing page and are inclusive of GST where applicable.

• Starter: A$9/month — 1 active project
• Advanced: A$19/month — Up to 5 active projects
• Professional: A$49/month — Unlimited projects
• Enterprise: A$249/month — Unlimited projects with dedicated support

Annual subscriptions are billed upfront and offer approximately 17% savings compared to monthly billing.

5. Cancellation and Refunds

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period — you will retain access until that date.

We do not offer refunds for partial billing periods. If you believe you have been charged in error, please contact us within 14 days at [email protected].

6. Acceptable Use

You agree not to use Solix to:

• Violate any applicable Australian or international laws or regulations.
• Upload or transmit malicious code, viruses, or harmful content.
• Attempt to gain unauthorised access to our systems or other users' accounts.
• Use the platform for any purpose other than legitimate construction project management.
• Reverse engineer, decompile, or attempt to extract the source code of the platform.
• Resell or sublicense access to the platform without our written consent.

7. Intellectual Property

All intellectual property rights in the Solix platform, including software, design, trademarks, and content, are owned by or licensed to Solix Hub Pty Ltd. These Terms do not grant you any rights to our intellectual property except the limited licence to use the platform as described herein.

You retain ownership of all data and content you upload to the platform ("User Content"). By uploading User Content, you grant us a non-exclusive licence to store and process it solely to provide the service.

8. Limitation of Liability

To the maximum extent permitted by Australian law, Solix Hub Pty Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including loss of profits, data, or business opportunities.

Our total liability to you for any claim arising under these Terms shall not exceed the total subscription fees paid by you in the 12 months preceding the claim.

9. Service Availability

We aim to maintain platform availability 24/7 but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance where possible. We are not liable for downtime caused by circumstances beyond our reasonable control, including third-party service outages.

10. Termination

We reserve the right to suspend or terminate your account immediately if you breach these Terms, engage in fraudulent activity, or for any other reason at our sole discretion. Upon termination, your right to access the platform ceases immediately.

You may delete your account at any time from your account settings. We will retain your data for 90 days following deletion before permanent removal, unless required by law to retain it longer.

11. Governing Law

These Terms are governed by the laws of the State of Victoria, Australia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Victoria.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the platform at least 14 days before the changes take effect. Continued use of Solix after changes take effect constitutes acceptance of the updated Terms.
